Welcome to Porthas Protect. These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, "Services") provided by Porthas Inc. ("Porthas," "we," "us," or "our").

By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Description of Services

Porthas Protect provides the following digital protection services:

  • Cloud Backup: Automated backup and recovery of your files and data
  • VPN (Virtual Private Network): Encrypted internet connection to protect your online privacy
  • Privacy Protection: Scanning and removal of your personal information from data broker websites
  • Identity Protection: Monitoring for identity theft, including dark web monitoring and credit monitoring
  • Identity Restoration: Assistance recovering from identity theft (Ultimate plan only)
  • Antivirus Protection: Real-time malware and threat protection (Ultimate plan only)

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use our Services. By using our Services, you represent that you meet these requirements.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us of any unauthorized access to your account. You are responsible for all activities that occur under your account.

2.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3. Subscription Plans and Payment

3.1 Subscription Tiers

We offer three subscription tiers with varying features:

  • Common: Basic backup and VPN services
  • More: Enhanced backup, VPN, privacy protection, and email aliases
  • Ultimate: All features including identity protection, identity restoration with up to $1,000,000 coverage, and antivirus

3.2 Billing

Subscriptions are billed on a recurring basis (monthly or annually) according to your selected plan. By providing a payment method, you authorize us to charge the applicable fees.

3.3 Price Changes

We may modify pricing with 30 days' notice. Price changes will take effect at the start of your next billing cycle.

3.4 Refunds

You may cancel your subscription at any time. Refunds are provided at our discretion and typically not issued for partial billing periods. Contact support for refund requests.

4. Acceptable Use

You agree NOT to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Use the VPN to engage in illegal activities, including but not limited to copyright infringement, fraud, or distribution of malware
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers
  • Share your account credentials with others
  • Use the Services to send spam or unsolicited communications
  • Resell or redistribute the Services without authorization
  • Reverse engineer, decompile, or attempt to derive the source code of our software

5. Service-Specific Terms

5.1 Cloud Backup

  • Storage limits apply based on your subscription tier
  • You are responsible for maintaining your backup encryption password; if lost, your data cannot be recovered
  • We are not responsible for data loss due to user error or failure to properly configure backups
  • Backup data is retained for 90 days after subscription cancellation

5.2 VPN Service

  • We do not log your browsing activity or traffic
  • VPN performance depends on network conditions and server load
  • Some websites or services may block VPN connections; we cannot guarantee access to all content
  • The VPN is provided for personal, non-commercial use only

5.3 Privacy Protection

  • Data broker removal is not guaranteed; some brokers may not honor removal requests
  • Your information may reappear on data broker sites over time; ongoing monitoring and removal is part of the service
  • We act as your authorized agent to submit removal requests on your behalf

5.4 Identity Protection

  • Monitoring services check for compromised credentials and suspicious activity
  • We alert you to potential threats; you are responsible for taking recommended actions
  • Credit monitoring requires your authorization and is subject to credit bureau terms

5.5 Identity Restoration (Ultimate Plan)

  • Available only to Ultimate plan subscribers
  • Includes up to $1,000,000 in identity theft insurance coverage
  • CIPA-certified specialists assist with restoration
  • Subject to insurance policy terms and conditions
  • You must cooperate fully with the restoration process

6. Intellectual Property

All content, features, and functionality of the Services are owned by Porthas Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

While we take reasonable measures to protect against security threats, no system is completely secure. We do not guarantee protection against all forms of identity theft, data breaches, or cyberattacks.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTHAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Porthas, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

10.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

10.2 By Us

We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or illegal activity. We may also terminate Services with 30 days' notice for any other reason.

10.3 Effect of Termination

Upon termination, your access to the Services will cease. Your backup data will be deleted within 90 days. VPN access terminates immediately.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a legal claim, you agree to contact us at legal@porthas.com to attempt to resolve the dispute informally.

11.2 Arbitration

Any disputes not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Cleveland, Ohio.

11.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in any class action or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Services at least 30 days before the changes take effect. Your continued use after changes constitutes acceptance.

14. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Porthas regarding the Services.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not waive our right to enforce it later.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
